Korematsu v. United States

Korematsu v. United States, 584 F. Supp. 1406 (N.D. Ca. 1984)

Vacating the 1942 conviction of Fred Korematsu, a U.S. citizen of Japanese descent for being in a place where all persons of Japanese ancestry were excluded during World War II, because the government had misled the court during WWII but declining to find an error of law so that the original case remains as legal precedent.

 

Yasui v. United States

Yasui v. United States , Criminal No. C 16056, Civil No. 83-151-BE (D. Ore. Jan. 26, 1984)

Vacating the 1942 conviction of Mr. Yasui for violating a curfew imposed against Japanese Americans but declining to make findings of fact with respect to governmental misconduct in the original case as requested by Mr. Yasui.

Yasui v. United States, 772 F. 2d 1496 (9th Cir. 1985)

Finding Mr. Yasui’s appeal untimely but remanding to the district court to give Mr. Yasui an opportunity to request an extension of time to appeal.

 

Hirabayashi v. United States

Hirabayashi v. United States, 627 F. Supp. 1445 (W.D. Wash. 1986)

Vacating Gordon Hirabayashi’s conviction for failing to report to a command center during WWII, i.e., the exclusion conviction, but declining to vacate his conviction for violating the curfew order.

Hirabayashi v. United States, 828 F. 2d 591 (9th Cir. 1987)

Affirming the vacating of Gordon Hirabayashi’s conviction for failing to report to a command center during WWII and reversing and remanding to the district court to vacate the conviction for violation of the curfew order.
